Terms & Conditions for
Computer Goods and Services

 

 

Symsys Ltd herin is referred to as 'Symsys'.

Website...

Every care has been taken in the preparation of the content of the Symsys® web site. Errors and omissions accepted. Symsys does not accept any responsibility for any web site not under our control, which may act as a portal for our site, or be connected by hypertext links from our site. Unless otherwise stated, all prices on the Symsys website are INCLUSIVE of New Zealand goods & services tax (GST) at 12.5%.

Payment...
Payment in full for goods and any delivery charges is due immediately upon Symsys accepting the Customer's order. Quotations given to the customer will not be deemed to constitute an offer. No supply of goods will be made between Symsys and the Customer unless and until an order by the Customer is accepted by Symsys.

Delivery...
Symsys will deliver the Goods to the Customer by the means of a courier service selected by Symsys and will use reasonable endeavours to deliver within 7 days of receiving full payment for the order. Deliveries may be subject to conditions outside our control and Symsys will not be held liable for any compensation or damages as a result of late or non-delivery. If we do not supply the goods we will refund any money already paid.You will be responsible for the Goods once the delivery is made or delayed by you at delivery. Please check the Goods on delivery. If the Goods are delivered damaged or faulty you must inform us within 10 days of delivery. If you do not inform us within 10 days we shall have no liability for goods said to be damaged on delivery.

Returns / Cancellation...
It is not acceptable to break any seals on the accompanying software or on the item itself. Whether goods are returned in a sellable condition is to be judged by Symsys. We do not accept liability for the costs of return, returns damaged in transit or not received by us. Non-faulty items returned to our premises complete with packaging, manuals and software disks within 7 working days of purchase may obtain a full refund. Goods must be sellable as new in order to qualify for a full refund. Outside of 7 working days, non faulty items will not be refunded under any circumstances.

Any cancellation or alteration of all or any part of an order is subject to written acceptance by Symsys and, without prejudice to the generality of the foregoing, if the Customer:- (a) Cancels or reduces all or any part of the order; or (b) Fails to meet any obligation hereunder which gives rise to cancellation or re-scheduling of delivery and Symsys™ is unable to resell the Goods within 14 days of cancellation; or (c) The Symsys™ supplier is not willing to accept the goods; then Symsys reserves the right to charge 30% of the list price of the goods. Computer Systems built to the customers individual specifications are exempt from the right to cancel under the Distance Selling Regulations.

Warranty...
Symsys™ offers a one-year Return to Base Warranty on new products. Symsys's only responsibility under this warranty shall be either to repair or (at Symsys option), whether they are components, sub-assemblies or systems, replace any component of the goods, sub-assembly, or system which fails during the warranty period due to defect in the workmanship or materials provided that the customer notifies Symsys within the warranty period identifying the specific defect. If the Goods are not defective within the terms of this warranty the Customer shall pay to Symsys the full cost of repair including transportation at Symsys's current rates. Should any product carry manufacturers extended warranty period it is the sole responsibility of the buyer to liaise directly with the manufacturer of the product for full details of the warranty agreement should it be found faulty.

Liability-Hardware...
Symsys does not accept responsibility for the loss of any software or data stored on any system or storage media handed to Symsys for inspection, repair, upgrade or other. Symsys does not accept responsibility for any failures to the buyers components. Symsys give no assurance as to the mutual compatibility of components sold on any single invoice. Except where the buyer is dealing as a consumer, all other warranties, conditions, conditions and terms relating to the fitness for purpose, merchantability or condition of the goods, whether implied by Statute, Common Law or otherwise are excluded and the buyer warrants that the buyer is satisfied as to the suitability of the goods for the buyers purpose.

Liability-Software...
The Customer is bound by the terms of the software license supplied with the software. Where any such license requires the Customer to sign a copy of it and return it to the licensor, the Customer will comply with any such requirement. Documentation, test equipment, software (for which a license has not been obtained), and associated media to be used by Symsys personnel at the place of installation, shall remain the exclusive property of Symsys and shall be for Symsys's sole use.
Symsys shall be entitled to supply substitute Goods of equivalant functionality, quality and price to the Goods in the event of any alteration by a supplier to Symsys of the design or specification of Goods supplied to Symsys.

The Customer agrees that Symsys may put its name and other details obtained from the order form into a computerised database for Symsys use and enable Symsys to provide the Service unless the Customer gives specific written instructions to the contrary. Symsy™ shall not be liable for any failure to perform its obligations under this Agreement if such failure results from an Act of God, riot, war, malicious acts of damage, fires, electrical supply failure, Government authority or any other cause beyond its reasonable control (including without any limitation, any mechanical, electronic or communication failure).

These terms and conditions are subject only to NZ law and do not affect your statutory rights.
